(Bafra \u015eubesi) aras\u0131nda yap\u0131lan, 01.05.2022 tarihinden itibaren 36 Ay s\u00fcreyi kapsayan Maa\u015f Promosyon S\u00f6zle\u015fmesi kapsam\u0131nda \u00f6ng\u00f6r\u00fclen b\u00fct\u00e7enin, atama tarihinden itibaren hesaplanarak taraf\u0131na \u00f6denmesi i\u00e7in dilek\u00e7e ile talepte bulundu\u011funu,<\/p>\n<p>3- \u0130l\u00e7e Milli E\u011fitim M\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn \u201cEksik evrak (\u00d6nceki okulumdan promosyon almad\u0131\u011f\u0131m ya da iade etti\u011fimi ifade eden belge) tespit edildi\u011finden i\u015fleme al\u0131nmam\u0131\u015ft\u0131r.\u201d i\u00e7erikli 24.11.2023 tarih, say\u0131l\u0131 cevabi yaz\u0131s\u0131 ile reddedildi\u011fini,<\/p>\n<p>4- \u00d6nceki okulunda Yap\u0131 Kredi Bankas\u0131ndan Promosyon ald\u0131\u011f\u0131n\u0131,<\/p>\n<p>5-<strong> \u0130lgili bankan\u0131n yer de\u011fi\u015fikli\u011finde promosyon iadesi istemedi\u011fini, yeni g\u00f6rev yerinde ise; Ak Bank ile s\u00f6zle\u015fme yap\u0131ld\u0131\u011f\u0131n\u0131 belirterek; kalan s\u00fcreyi kapsayan promosyonun taraf\u0131na \u00f6denmesini,<\/strong><\/p>\n<p>talep etmektedir.<\/p>\n<p>Ba\u015fvuran\u0131n talebine Kamu Denet\u00e7ili\u011fi taraf\u0131ndan verilen tavsiye karar\u0131 promosyon \u00f6demelerinde \u00f6nemli bir ad\u0131m olmu\u015ftur. Kurumumuzun 24.01.2024 tarihli ve say\u0131l\u0131 yaz\u0131s\u0131 ile \u015fik\u00e2yet ba\u015fvurusunun \u00e7\u00f6z\u00fcme kavu\u015fturulmas\u0131 amac\u0131yla 19 May\u0131s \u0130l\u00e7e Milli E\u011fitim M\u00fcd\u00fcrl\u00fc\u011f\u00fcnden bilgi ve belge talebinde bulunulmu\u015ftur. 19 May\u0131s \u0130l\u00e7e Milli E\u011fitim M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan Kurumumuza g\u00f6nderilen 26.07.2023 tarihli ve say\u0131l\u0131 cevabi yaz\u0131 ve eklerinde \u00f6zetle;<\/p>\n<p>2.1 Ba\u015fvuran\u0131n, \u00c7ar\u015famba Mesleki ve Teknik Anadolu Lisesi \u00f6\u011fretmeni iken 26.07.2023 tarihi itibariyle Ball\u0131ca Mesleki ve Teknik Anadolu Lisesinde Elektrik ve Elektronik Teknolojisi \u00f6\u011fretmeni olarak g\u00f6reve ba\u015flad\u0131\u011f\u0131,<\/p>\n<p>2.2 Ba\u015fvuran\u0131n, \u00c7ar\u015famba Mesleki ve Teknik Anadolu Lisesi \u00f6\u011fretmeni iken \u00c7ar\u015famba \u0130l\u00e7e Milli E\u011fitim M\u00fcd\u00fcrl\u00fc\u011f\u00fc ile Yap\u0131 Kredi Bankas\u0131 aras\u0131nda imzalanan maa\u015f \u00f6demeleri protokol s\u00f6zle\u015fmesi kapsam\u0131nda promosyon \u00f6demesini ald\u0131\u011f\u0131,<\/p>\n<p style=\"text-align:justify\">2.3 19 May\u0131s \u0130l\u00e7e Milli E\u011fitim M\u00fcd\u00fcrl\u00fc\u011f\u00fc ile AKBANK T.A.\u015e aras\u0131nda 01.05.2022 tarihinde 36 ay ge\u00e7erli olacak \u015fekilde imzalanan maa\u015f \u00f6demeleri protokol s\u00f6zle\u015fmesinin 12. Maddesinde; Kurumun s\u00f6zle\u015fmenin 1. Maddesinde belirtilen \u00f6demelerine, Banka taraf\u0131ndan arac\u0131l\u0131k edilmesi kar\u015f\u0131l\u0131\u011f\u0131nda, nakdi olarak tek seferde \u00f6denmek \u00fczere ki\u015fiba\u015f\u0131 9.050TL b\u00fct\u00e7e ayr\u0131ld\u0131\u011f\u0131n\u0131, Kurumda sonradan i\u015fe ba\u015flayan personel i\u00e7in ilk maa\u015f ald\u0131\u011f\u0131 aydan s\u00f6zle\u015fme vadesine oranla k\u0131stelyevm hesab\u0131na g\u00f6re ek b\u00fct\u00e7e tahsisi yap\u0131laca\u011f\u0131, ek b\u00fct\u00e7e tahsisi yap\u0131lacak ki\u015filerin geldi\u011fi kurumdan i\u015f bu s\u00f6zle\u015feme vadesi ile \u00e7ak\u0131\u015facak \u015fekilde b\u00fct\u00e7e almad\u0131\u011f\u0131n\u0131 belgelemesi \u015fart\u0131 olup, kontrol\u00fcn yap\u0131lmas\u0131n\u0131n Kurum sorumlulu\u011funda oldu\u011fu bu kapsamda ba\u015fvuran\u0131n geldi\u011fi kurum olan \u00c7ar\u015famba \u0130l\u00e7e Milli E\u011fitim M\u00fcd\u00fcrl\u00fc\u011f\u00fc ile Yap\u0131 Kredi Bankas\u0131 aras\u0131nda imzalanan maa\u015f \u00f6demeleri protokol s\u00f6zle\u015fmesi kapsam\u0131nda promosyon \u00f6demesi ald\u0131\u011f\u0131 i\u00e7in \u00f6demenin yap\u0131lamayaca\u011f\u0131 belirtilmi\u015ftir.<\/p>\n<p><strong>III. \u0130LG\u0130L\u0130 MEVZUAT<\/strong><\/p>\n<p>3. 2709 say\u0131l\u0131 T.C. Anayasas\u0131\u2019n\u0131n;<\/p>\n<p>3.1 \u201cCumhuriyetin nitelikleri\u201d ba\u015fl\u0131kl\u0131 2. maddesinde; \u201cT\u00fcrkiye Cumhuriyeti, toplumun huzuru, mill\u00ee dayan\u0131\u015fma ve adalet anlay\u0131\u015f\u0131 i\u00e7inde, insan haklar\u0131na sayg\u0131l\u0131, Atat\u00fcrk milliyet\u00e7ili\u011fine ba\u011fl\u0131, ba\u015flang\u0131\u00e7ta belirtilen temel ilkelere dayanan, demokratik, l\u00e2ik ve sosyal bir hukuk Devletidir\u201d,<\/p>\n<p>3.2 \u201cY\u00fcr\u00fctme yetkisi ve g\u00f6revi\u201d ba\u015fl\u0131kl\u0131 8. maddesinde; \u201cY\u00fcr\u00fctme yetkisi ve g\u00f6revi, Cumhurba\u015fkan\u0131 (\u2026)(1) taraf\u0131ndan, Anayasaya ve kanunlara uygun olarak kullan\u0131l\u0131r ve yerine getirilir.\u201d,<\/p>\n<p>3.3 \u201cI. Temel hak ve h\u00fcrriyetlerin niteli\u011fi\u201d ba\u015fl\u0131kl\u0131 12. maddesinde; \u201c Herkes, ki\u015fili\u011fine ba\u011fl\u0131, dokunulmaz, devredilmez, vazge\u00e7ilmez temel hak ve h\u00fcrriyetlere sahiptir. Temel hak ve h\u00fcrriyetler, ki\u015finin topluma, ailesine ve di\u011fer ki\u015filere kar\u015f\u0131 \u00f6dev ve sorumluluklar\u0131n\u0131 da ihtiva eder.\u201d<\/p>\n<p>3.4 \u201cII: Temel hak ve h\u00fcrriyetlerin s\u0131n\u0131rlanmas\u0131\u201d ba\u015fl\u0131kl\u0131 13. maddesinde; \u201cTemel hak ve h\u00fcrriyetler, \u00f6zlerine dokunulmaks\u0131z\u0131n yaln\u0131zca Anayasan\u0131n ilgili maddelerinde belirtilen sebeplere ba\u011fl\u0131 olarak ve ancak kanunla s\u0131n\u0131rlanabilir. Bu s\u0131n\u0131rlamalar, Anayasan\u0131n s\u00f6z\u00fcne ve ruhuna, demokratik toplum d\u00fczeninin ve l\u00e2ik Cumhuriyetin gereklerine ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine ayk\u0131r\u0131 olamaz.\u201d<\/p>\n<p>3.5 \u201cM\u00fclkiyet hakk\u0131\u201d ba\u015fl\u0131kl\u0131 35. maddesinde; \u201cHerkes, m\u00fclkiyet ve miras haklar\u0131na sahiptir. Bu haklar, ancak kamu yarar\u0131 amac\u0131yla, kanunla s\u0131n\u0131rlanabilir. M\u00fclkiyet hakk\u0131n\u0131n kullan\u0131lmas\u0131 toplum yarar\u0131na ayk\u0131r\u0131 olamaz.\u201d 3.6 \u201cHak arama h\u00fcrriyeti\u201d ba\u015fl\u0131kl\u0131 36. maddesinde; \u201cHerkes, me\u015fr\u00fb vas\u0131ta ve yollardan faydalanmak suretiyle yarg\u0131 mercileri \u00f6n\u00fcnde davac\u0131 veya daval\u0131 olarak iddia ve savunma ile adil yarg\u0131lanma hakk\u0131na sahiptir\u2026\u201d<\/p>\n<p>3.7 \u201cDilek\u00e7e, bilgi edinme ve kamu denet\u00e7isine ba\u015fvurma hakk\u0131\u201d ba\u015fl\u0131kl\u0131 74. maddesinin \u00fc\u00e7\u00fcnc\u00fc ve d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131nda; \u201cHerkes, bilgi edinme ve kamu denet\u00e7isine ba\u015fvurma hakk\u0131na sahiptir. T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi Ba\u015fkanl\u0131\u011f\u0131na ba\u011fl\u0131 olarak kurulan Kamu Denet\u00e7ili\u011fi Kurumu idarenin i\u015fleyi\u015fiyle ilgili \u015fik\u00e2yetleri inceler.\u201d<\/p>\n<p>4. Birle\u015fmi\u015f Milletler \u0130nsan Haklar\u0131n\u0131n Geli\u015ftirilmesi ve Korunmas\u0131 \u0130\u00e7in Kurulan Ulusal Kurulu\u015flar\u0131n Stat\u00fcs\u00fcne \u0130li\u015fkin \u0130lkeler\/Paris Prensiplerinde; &#8220;&#8230;Ulusal kurulu\u015flar, y\u00fcr\u00fcrl\u00fckteki yasalar\u0131, mevzuat\u0131 ve yasa tasar\u0131lar\u0131 ile yasa \u00f6nerilerini incelerler ve metinlerin, insan haklar\u0131n\u0131n temel ilkeleriyle uyumlu hale getirilmeleri i\u00e7in uygun g\u00f6rd\u00fckleri tavsiyeleri yaparlar\u037e gerek g\u00f6rd\u00fckleri takdirde, yeni yasalar\u0131n kabul edilmesini, y\u00fcr\u00fcrl\u00fckteki yasalar\u0131n uyumlu hale getirilmesini ve idari \u00f6nlemlerin al\u0131nmas\u0131n\u0131 veya de\u011fi\u015ftirilmesini tavsiye ederler. Ulusal d\u00fczeyde y\u00fcr\u00fcrl\u00fckte olan yasalar\u0131n, mevzuat\u0131n ve uygulamalar\u0131n, insan haklar\u0131na ili\u015fkin uluslararas\u0131 belgeler ve mekanizmalarla uyumlu hale getirilmesini ve hayata ge\u00e7irilmesini te\u015fvik ederler ve sa\u011flarlar.&#8221;<\/p>\n<p>5. 6328 say\u0131l\u0131 Kamu Denet\u00e7ili\u011fi Kurumu Kanununun \u201cKurumun g\u00f6revi\u201d ba\u015fl\u0131kl\u0131 5. maddesinde; \u201cKurum, idarenin i\u015fleyi\u015fi ile ilgili \u015fik\u00e2yet \u00fczerine, idarenin her t\u00fcrl\u00fc eylem ve i\u015flemleri ile tutum ve davran\u0131\u015flar\u0131n\u0131\u037e insan haklar\u0131na dayal\u0131 adalet anlay\u0131\u015f\u0131 i\u00e7inde, hukuka ve hakkaniyete uygunluk y\u00f6nlerinden incelemek, ara\u015ft\u0131rmak ve idareye \u00f6nerilerde bulunmakla g\u00f6revlidir\u2026.\u201d<\/p>\n<p>6. 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanununun 164. maddesinin d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131nda; &#8220;\u00dc\u00e7\u00fcnc\u00fc f\u0131kra kapsam\u0131na giren personelin her t\u00fcrl\u00fc \u00f6zl\u00fck haklar\u0131n\u0131n ve tahakkuk i\u015flemlerinin belli merkezlerden yap\u0131labilmesi ve \u00f6demelerin bankac\u0131l\u0131k sistemi arac\u0131l\u0131\u011f\u0131 ile ger\u00e7ekle\u015ftirilmesi i\u00e7in gerekli d\u00fczenlemeleri yapmaya ve gerekli tedbirleri almaya Maliye Bakanl\u0131\u011f\u0131 yetkilidir.\u201d,<\/p>\n<p>7. 6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanununun \u201c\u00dc\u00e7\u00fcnc\u00fc ki\u015fi yarar\u0131na s\u00f6zle\u015fme\u201d ba\u015fl\u0131kl\u0131 129. maddesi; \u201cKendi ad\u0131na s\u00f6zle\u015fme yapan ki\u015fi, s\u00f6zle\u015fmeye \u00fc\u00e7\u00fcnc\u00fc ki\u015fi yarar\u0131na bir edim y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc koydurmu\u015fsa, edimin \u00fc\u00e7\u00fcnc\u00fc ki\u015fiye ifa edilmesini isteyebilir. \u00dc\u00e7\u00fcnc\u00fc ki\u015fi veya \u00fc\u00e7\u00fcnc\u00fc ki\u015fiye halef olanlar da, taraflar\u0131n amac\u0131na veya \u00f6rf ve \u00e2dete uygun d\u00fc\u015ft\u00fc\u011f\u00fc takdirde edimin ifas\u0131n\u0131 isteyebilirler. Bu durumda, \u00fc\u00e7\u00fcnc\u00fc ki\u015fi veya ona halef olanlar bu hakk\u0131 kullanmak istediklerini bor\u00e7luya bildirdikten sonra, alacakl\u0131 bor\u00e7luyu ibra edemeyece\u011fi gibi, borcun nitelik ve kapsam\u0131n\u0131 da de\u011fi\u015ftiremez.\u201d,<\/p>\n<p>8. 20\/07\/2007 tarihli ve 26588 say\u0131l\u0131 Resmi Gazetede yay\u0131mlanan 2007\/21 say\u0131l\u0131 Ba\u015fbakanl\u0131k Genelgesinin,<\/p>\n<p>8.1 4. maddesinde; &#8220;Banka taraf\u0131ndan verilecek promosyon miktar\u0131n\u0131n tamam\u0131 personele da\u011f\u0131t\u0131lacakt\u0131r&#8221;,<\/p>\n<p>8.2 2. maddesinde; \u201c 2- Ayl\u0131k ve \u00fccretlerin hangi banka arac\u0131l\u0131\u011f\u0131 ile \u00f6denece\u011fi, olu\u015fturulacak \u00fc\u00e7 ki\u015filik bir komisyon taraf\u0131ndan istekli bankalardan teklif al\u0131nmak suretiyle tespit edilecektir. Komisyon, kamu kurum ve kurulu\u015flar\u0131n\u0131n ilgili biriminin harcama yetkilisinin ba\u015fkanl\u0131\u011f\u0131nda s\u00f6z konusu birimde g\u00f6rev yapan toplam personelin en az % 10\u2019unun sendikal\u0131 olmas\u0131 halinde yetkili sendikadan bir \u00fcye ile merkez te\u015fkilat\u0131nda \u00fcst y\u00f6netici\u037e ta\u015fra te\u015fkilat\u0131nda ise o birimin ba\u011fl\u0131 bulundu\u011fu bir \u00fcst amir taraf\u0131ndan ilgili birimde g\u00f6rev yapanlar aras\u0131ndan se\u00e7ilecek bir \u00fcyeden olu\u015facakt\u0131r. Yetkili sendikadan \u00fcye bulunmad\u0131\u011f\u0131 durumlarda \u00fc\u00e7\u00fcnc\u00fc \u00fcye ilgili birimde g\u00f6rev yapan personel aras\u0131ndan harcama yetkilisi taraf\u0131ndan se\u00e7ilecektir. Ba\u015fvuran\u0131n; \u201ctaraf\u0131na promosyon \u00f6demesi yap\u0131lmas\u0131 \u201d talebine ili\u015fkin olarak;<\/p>\n<p>13.1 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanunu\u2019nun 164\u2019\u00fcnc\u00fc maddesinde, madde kapsam\u0131na giren personelin her t\u00fcrl\u00fc \u00f6zl\u00fck haklar\u0131n\u0131n ve tahakkuk i\u015flemlerinin belli merkezlerden yap\u0131labilmesi ve \u00f6demelerin bankac\u0131l\u0131k sistemi arac\u0131l\u0131\u011f\u0131 ile ger\u00e7ekle\u015ftirilmesi i\u00e7in gerekli d\u00fczenlemeleri yapmaya ve gerekli tedbirleri almaya Maliye Bakanl\u0131\u011f\u0131\u2019n\u0131n yetkili oldu\u011fu h\u00fckme ba\u011flanm\u0131\u015ft\u0131r. S\u00f6z konusu d\u00fczenleme gere\u011fince \u00e7\u0131kar\u0131lan 17\/07\/2012 tarihli ve 28356 say\u0131l\u0131 Resmi Gazetede yay\u0131mlanan Muhasebat Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc\u2019n\u00fcn 34 S\u0131ra No\u2019lu Genel Tebli\u011fi\u2019nde ise; kamu personelinin maa\u015flar\u0131n\u0131n bankalar vas\u0131tas\u0131yla \u00f6denmesine y\u00f6nelik usul ve esaslar belirlenmi\u015ftir.<\/p>\n<p>13.2 Bu do\u011frultuda kamu personelinin maa\u015flar\u0131n\u0131n \u00f6denmesi i\u00e7in ilgili kurumlarla anla\u015fan bankalar, s\u00f6z konusu m\u00e2li haklara ili\u015fkin protokoller akdetmekte ve bu protokoller gere\u011fince elde etti\u011fi gelirler \u00fczerinden, \u201cpromosyon\u201d ad\u0131 verilen ek m\u00e2li imk\u00e2nlar\u0131 ilgili kurumlara sa\u011flamaktad\u0131r. Bankalar\u0131n sundu\u011fu bu imk\u00e2nlar\u0131n, kamu kurum-kurulu\u015flar\u0131 taraf\u0131ndan ne \u015fekilde de\u011ferlendirilece\u011fi ve personelin bunlardan yararlan\u0131p yararlanmayaca\u011f\u0131na ili\u015fkin olarak 20\/07\/2007 tarihli ve 26588 say\u0131l\u0131 Resmi Gazetede yay\u0131mlanan 2007\/21 say\u0131l\u0131 Ba\u015fbakanl\u0131k Genelgesi haz\u0131rlanm\u0131\u015ft\u0131r.<\/p>\n<p>13.3 20\/07\/2007 tarihli ve 26588 say\u0131l\u0131 Resm\u00ee Gazete&#8217; de yay\u0131mlanan &#8220;Banka Promosyonlar\u0131&#8221; konulu 2007\/21 say\u0131l\u0131 Ba\u015fbakanl\u0131k Genelgesi&#8217;nin 1. promosyon \u00f6denmesi talebinin, idare taraf\u0131ndan yeni atand\u0131\u011f\u0131ndan bahisle reddedilmesi \u00fczerine a\u00e7\u0131lan bir iptal davas\u0131nda; Mahkeme \u00f6zetle; daval\u0131 idare taraf\u0131ndan, maa\u015flar\u0131n al\u0131nd\u0131\u011f\u0131 bankayla imzalanan protokol tarihi itibariyle g\u00f6revli olan her bir personele \u00f6deme yap\u0131ld\u0131\u011f\u0131, davac\u0131n\u0131n bu tarihten sonra g\u00f6reve ba\u015flamas\u0131 nedeniyle davac\u0131ya \u00f6deme yapma imkan\u0131 bulunmad\u0131\u011f\u0131 \u00f6ne s\u00fcr\u00fclm\u00fc\u015f ise de, Ba\u015fbakanl\u0131\u011f\u0131n gerek 20.07.2007 tarih ve 26588 say\u0131l\u0131 Resmi Gazete&#8217;de yay\u0131mlanan promosyon genelgesinde ve gerekse an\u0131lan genelgede de\u011fi\u015fiklik yapan 2008\/18 say\u0131l\u0131 Genelgesinde, bu t\u00fcr promosyon \u00f6demelerinin personele pe\u015fin olarak yap\u0131lmas\u0131 y\u00f6n\u00fcnde bir d\u00fczenleme getirmedi\u011fi gibi, imzalanan protokol\u00fcn ileriye d\u00f6n\u00fck sonu\u00e7lar do\u011furdu\u011fu ve protokol imzaland\u0131\u011f\u0131 ve \u00f6deme yap\u0131ld\u0131\u011f\u0131 tarihte protokol kapsam\u0131 d\u0131\u015f\u0131nda bir kurumda g\u00f6rev yapmakta iken, \u00f6deme yap\u0131ld\u0131ktan sonra protokol kapsam\u0131ndaki bir kuruma atanan personelin protokol sonuna kadar maa\u015f\u0131n\u0131 an\u0131lan bankadan alaca\u011f\u0131 da dikkate al\u0131nd\u0131\u011f\u0131nda, maa\u015f ve di\u011fer \u00f6zl\u00fck haklar\u0131n\u0131 an\u0131lan banka arac\u0131l\u0131\u011f\u0131 ile elde eden ve protokol sonuna kadar da bu \u015fekilde elde etmeye devam edecek olan personelin, protokol kapsam\u0131nda yap\u0131lan \u00f6demeden yararland\u0131r\u0131lmas\u0131n\u0131n hakkaniyet ilkesinin bir gere\u011fi oldu\u011fu, protokol\u00fcn kalan s\u00fcresiyle orant\u0131l\u0131 \u015fekilde promosyon \u00fccretinden yararland\u0131r\u0131lmas\u0131 gerekirken, maa\u015f protokol\u00fc imzaland\u0131ktan ve promosyon paylar\u0131 mevcut personele \u00f6dendikten sonra g\u00f6reve ba\u015flamas\u0131 gerek\u00e7e g\u00f6sterilerek, hali haz\u0131rda devam edecek olan protokol uyar\u0131nca yap\u0131lan \u00f6demelerden yararland\u0131r\u0131lmamas\u0131na dair i\u015flemin hukuka ve hakkaniyete ayk\u0131r\u0131 oldu\u011funu belirtmi\u015ftir.(Ordu \u0130dare Mahkemesinin; 2010\/1327 Esas, 2011\/1460 Karar say\u0131l\u0131 ve 28.11.2011)<\/p>\n<p style=\"text-align:justify\">13.6 Kurumumuza yap\u0131lan \u201cBanka ile yap\u0131lan promosyon protokol\u00fcnden sonra g\u00f6reve ba\u015flayan \u015fik\u00e2yet\u00e7iye promosyon \u00fccreti \u00f6denmemesi\u201d konulu ba\u015fvuru hakk\u0131nda; idarenin de iradesini ortaya koyarak imzalad\u0131\u011f\u0131 protokolden kaynaklanan uyu\u015fmazl\u0131klarda idarenin hi\u00e7bir sorumlulu\u011funun bulunmad\u0131\u011f\u0131n\u0131n kabul edilemeyece\u011fi, bu anlamda idarenin, protokol\u00fc imzalad\u0131\u011f\u0131 tarihte basiretli davranmas\u0131 gerekti\u011fi ve Kurumunda daha sonra yeni \u00e7al\u0131\u015fanlar istihdam edilece\u011finin hesaplamas\u0131, \u00f6ng\u00f6r\u00fclebilirlik ilkesine uygun hareket edilerek s\u00f6zle\u015fme h\u00fck\u00fcmlerini tart\u0131\u015farak imza alt\u0131na al\u0131nmas\u0131 gerekti\u011fi, aksi takdirde \u0130darenin, Anayasan\u0131n 125. maddesinde de yer verildi\u011fi \u00fczere, \u00e7al\u0131\u015fan\u0131na vermi\u015f oldu\u011fu bu zarar\u0131 tazmin etmekle y\u00fck\u00fcml\u00fc oldu\u011fu, ba\u015fvurucusunun m\u00fclkiyet hakk\u0131n\u0131 ilgilendiren, ki\u015fisel hakk\u0131yla ilgili, idarenin bankayla bir ba\u015fkas\u0131n\u0131n m\u00fclkiyet hakk\u0131na y\u00f6nelik hakk\u0131ndan feragatini do\u011furacak \u015fekilde protokol imzalamas\u0131n\u0131n Medeni Kanunu, Bor\u00e7lar Kanunu vb. mevzuat h\u00fck\u00fcmlerine a\u00e7\u0131k\u00e7a ayk\u0131r\u0131 oldu\u011fu gibi s\u00f6zle\u015fme serbestisine de ayk\u0131r\u0131 oldu\u011fu yine protokol tarihinden sonra g\u00f6reve ba\u015flayan personele promosyon \u00f6demesi yap\u0131lmamas\u0131n\u0131n, Anayasan\u0131n 10. maddesinde yer alan e\u015fitlik ilkesine de ayk\u0131r\u0131l\u0131k te\u015fkil edece\u011fi, bu y\u00f6n\u00fcyle idarenin \u015fik\u00e2yete konu edilen i\u015fleminin hukuka ve hakkaniyete ayk\u0131r\u0131 oldu\u011fu de\u011ferlendirilmesiyle; protokol tarihinden sonra g\u00f6reve ba\u015flayan ba\u015fvurana, g\u00f6reve ba\u015flad\u0131\u011f\u0131 tarihi ile s\u00f6z konusu protokol\u00fcn ge\u00e7erli oldu\u011fu son tarih aras\u0131nda hesaplanacak promosyon tutar\u0131n\u0131n makul s\u00fcrede \u00f6denmesi ve promosyon s\u00f6zle\u015fmesi imzalanmas\u0131ndan sonra idarelerine a\u00e7\u0131ktan veya naklen atanacak personelin olabilece\u011fini g\u00f6z \u00f6n\u00fcnde bulundurularak ileride ya\u015fanabilecek benzer problemlerin \u00f6n\u00fcne ge\u00e7ilmesi amac\u0131yla bundan sonra yap\u0131lacak protokollerde bu durumlar\u0131n g\u00f6z \u00f6n\u00fcnde bulundurulmas\u0131 hususunda Tavsiye Karar\u0131 verildi\u011fi anla\u015f\u0131lm\u0131\u015ft\u0131r. (Bkz: Kamu Dnet\u00e7ili\u011fi kurumunun 2016\/1517 Ba\u015fvuru Numaral\u0131 ve 03\/10\/2016 say\u0131l\u0131 Tavsiye Karar\u0131)<\/p>\n<p style=\"text-align:justify\">13.7 Somut olayda; ba\u015fvuran\u0131n \u201cpromosyon s\u00f6zle\u015fmesinin bitim tarihine kadar hak etti\u011fi promosyon \u00f6demesinin yap\u0131lmas\u0131\u201d talebinin, idare taraf\u0131ndan, protokol h\u00fck\u00fcmleri kapsam\u0131nda ba\u015fvuran\u0131n geldi\u011fi kurum olan \u00c7ar\u015famba \u0130l\u00e7e Milli E\u011fitim M\u00fcd\u00fcrl\u00fc\u011f\u00fc ile Yap\u0131 Kredi Bankas\u0131 aras\u0131nda imzalanan maa\u015f \u00f6demeleri protokol s\u00f6zle\u015fmesi kapsam\u0131nda promosyon \u00f6demesi ald\u0131\u011f\u0131 i\u00e7in \u00f6demenin yap\u0131lamayaca\u011f\u0131 gerek\u00e7esiyle ret edildi\u011fi g\u00f6r\u00fclse de; promosyon bedelinin, kamu personelinin ayl\u0131k veya \u00fccretinin tamamlay\u0131c\u0131 par\u00e7as\u0131 oldu\u011fu, ba\u015fvuran\u0131n \u00c7ar\u015famba \u0130l\u00e7e Milli E\u011fitim M\u00fcd\u00fcrl\u00fc\u011f\u00fc b\u00fcnyesinde \u00e7al\u0131\u015f\u0131rken Yap\u0131 Kredi Bankas\u0131ndan maa\u015f\u0131n\u0131 ald\u0131\u011f\u0131 ve bu kapsamda kendisine Yap\u0131 Kredi Bankas\u0131 taraf\u0131ndan bir promosyon \u00f6demesi yap\u0131ld\u0131\u011f\u0131, ba\u015fvuran\u0131n g\u00f6reve ba\u015flama tarihi olan 26.07.2023 tarihinden, protokol\u00fcn ge\u00e7erlilik s\u00fcresi olan 36 ayl\u0131k s\u00fcre i\u00e7erisinde, AKBANK A.\u015e. arac\u0131l\u0131\u011f\u0131yla maa\u015f\u0131n\u0131 alaca\u011f\u0131, m\u00fclkiyet hakk\u0131n\u0131 ilgilendiren, ki\u015fisel hakk\u0131yla ilgili, idarenin bankayla bir ba\u015fkas\u0131n\u0131n m\u00fclkiyet hakk\u0131na y\u00f6nelik hakk\u0131ndan feragatini do\u011furacak \u015fekilde protokol imzalamas\u0131n\u0131n meri mevzuat h\u00fck\u00fcmlerine ve s\u00f6zle\u015fme serbestisine ayk\u0131r\u0131l\u0131k te\u015fkil edece\u011fi, idare taraf\u0131ndan imza alt\u0131na al\u0131nan protokol metninin 12. Maddesinde; Kurum personeline nakdi olarak tek seferde ki\u015fiba\u015f\u0131 9.050 TL Nakit Promosyon \u00f6demesi yap\u0131ld\u0131\u011f\u0131, , Kurumda sonradan i\u015fe ba\u015flayan personel i\u00e7in ilk maa\u015f ald\u0131\u011f\u0131 aydan s\u00f6zle\u015fme vadesine oranla k\u0131stelyevm hesab\u0131na g\u00f6re ek b\u00fct\u00e7e tahsisi yap\u0131laca\u011f\u0131 hususlar\u0131n\u0131n bulundu\u011fu, protokol\u00fcn imzaland\u0131\u011f\u0131 tarihte g\u00f6rev yapmakta olan personele promosyon \u00f6demesi yap\u0131l\u0131rken, protokol tarihinden sonra g\u00f6reve ba\u015flayan personele s\u00f6z konusu \u00f6demenin yap\u0131lmamas\u0131n\u0131n personel aras\u0131ndaki \u00e7al\u0131\u015fma bar\u0131\u015f\u0131na zarar verece\u011fi, protokol imzaland\u0131\u011f\u0131 ve \u00f6deme yap\u0131ld\u0131\u011f\u0131 tarihte protokol kapsam\u0131 d\u0131\u015f\u0131nda bir kurumda g\u00f6rev yapmakta iken, \u00f6deme yap\u0131ld\u0131ktan sonra protokol kapsam\u0131ndaki bir kuruma atanan personelin protokol sonuna kadar maa\u015f\u0131n\u0131 an\u0131lan bankadan alaca\u011f\u0131 da dikkate al\u0131nd\u0131\u011f\u0131nda, maa\u015f ve di\u011fer \u00f6zl\u00fck haklar\u0131n\u0131 an\u0131lan banka arac\u0131l\u0131\u011f\u0131 ile elde eden ve protokol sonuna kadar da bu \u015fekilde elde etmeye devam edecek olan personelin, protokol kapsam\u0131nda yap\u0131lan \u00f6demeden yararland\u0131r\u0131lmas\u0131n\u0131n hakkaniyet ilkesinin bir gere\u011fi oldu\u011fu de\u011ferlendirilmektedir.<\/p>\n<p>14. Ba\u015fvuran\u0131n iddialar\u0131, idarenin konuyla ilgili a\u00e7\u0131klamalar\u0131, ilgili mevzuat, yarg\u0131 kararlar\u0131 ve t\u00fcm dosya kapsam\u0131 birlikte de\u011ferlendirildi\u011finde; ba\u015fvuran\u0131n, promosyon \u00f6demesinin yap\u0131lmas\u0131 talebinin reddi i\u015fleminin hukuka ve hakkaniyete uygun olmad\u0131\u011f\u0131 sonu\u00e7 ve kanaatine var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p><strong>B. \u0130yi Y\u00f6netim \u0130lkeleri Y\u00f6n\u00fcnden De\u011ferlendirme<\/strong><\/p>\n<p>15. \u0130yi y\u00f6netim ilkelerine 28.03.2013 tarihli ve 28601 m\u00fckerrer say\u0131l\u0131 Resmi Gazetede yay\u0131mlanan Kamu Denet\u00e7ili\u011fi Kurumu Kanununun Uygulanmas\u0131na \u0130li\u015fkin Usul ve Esaslar Hakk\u0131nda Y\u00f6netmeli\u011fin 6 nc\u0131 maddesinde yer verilmi\u015f olup, idareden istenilen bilgi ve belgelerin s\u00fcresi i\u00e7inde ve gerek\u00e7eli olarak Kurumumuza g\u00f6nderildi\u011fi anla\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<h3><strong>VI. HAK ARAMA \u00d6ZG\u00dcRL\u00dc\u011e\u00dcNE \u0130L\u0130\u015eK\u0130N A\u00c7IKLAMA<\/strong><\/h3>\n<p>16. 14.06.2012 tarihli ve 6328 say\u0131l\u0131 Kamu Denet\u00e7ili\u011fi Kurumu Kanununun 17 nci maddesinin sekizinci f\u0131kras\u0131na g\u00f6re Kamu Denet\u00e7ili\u011fi Kurumuna dava a\u00e7ma s\u00fcresi i\u00e7inde yap\u0131lan ba\u015fvuru, i\u015flemeye ba\u015flam\u0131\u015f olan dava a\u00e7ma s\u00fcresini durdurmakta olup, an\u0131lan Kanunun 21\u2019inci maddesinin ikinci f\u0131kras\u0131 uyar\u0131nca, bu Karar\u0131n idareye tebli\u011f tarihinden itibaren 30 g\u00fcn i\u00e7inde idare taraf\u0131ndan herhangi bir eylem ya da i\u015flem tesis edilmezse (varsa) dava a\u00e7ma s\u00fcresinden kalan s\u00fcre i\u015flemeye devam edecek olup ilgili \u0130darenin i\u015flemine kar\u015f\u0131 Samsun \u0130dare Mahkemelerinde yarg\u0131 yolu a\u00e7\u0131kt\u0131r.<\/p>\n<p>VII.
