D\u00f6nem Toplu S\u00f6zle\u015fme maddelerinin, baz\u0131 kamu kurum ve kurulu\u015flar\u0131nda eksik uyguland\u0131\u011f\u0131, uygulamaya d\u00f6n\u00fck teredd\u00fctlerin ortaya \u00e7\u0131kt\u0131\u011f\u0131 ve benzer kurumlarda farkl\u0131 uygulamalar\u0131n meydana geldi\u011fi Memur-Sen&#8217;e iletilmi\u015ftir.<\/p>\n<p>Memur-Sen, belirlenen s\u00f6zle\u015fme maddelerinin etkili bir bi\u00e7imde hayata ge\u00e7irilmemesi ve uygulamaya dair ya\u015fanan belirsizlikleri gidermek ad\u0131na resmi bir yaz\u0131yla taleplerini iletti.<\/p>\n<p>\u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131&#8217;na g\u00f6nderilen yaz\u0131da, Memur-Sen&#8217;in taleplerinin yan\u0131 s\u0131ra, ya\u015fanan sorunlar\u0131n \u00e7\u00f6z\u00fcm\u00fcne dair \u00f6neriler de sunulmu\u015ftur.<\/p>\n<p>Memur-Sen Genel Ba\u015fkan Yard\u0131mc\u0131lar\u0131 Hac\u0131 Bayram Tonbul ve Ramazan \u00c7ak\u0131rc\u0131 imzas\u0131yla \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131\u2019na iletilen \u00fcst yaz\u0131da; K\u0130T ve benzeri kurumlardaki teknik personele ilave ek \u00f6deme verilmesi konusunda ya\u015fanan aksakl\u0131klara vurgu yap\u0131l\u0131rken \u015fu ifadeler kullan\u0131ld\u0131;<\/p>\n<p>\u201cBilindi\u011fi \u00fczere, 7. D\u00f6nem Toplu S\u00f6zle\u015fme g\u00f6r\u00fc\u015fmeleri uzla\u015fmazl\u0131kla sonu\u00e7lanm\u0131\u015f ve kamu g\u00f6revlilerinin mali, sosyal ve \u00f6zl\u00fck haklar\u0131 ile \u00e7al\u0131\u015fma \u015fartlar\u0131, Kamu G\u00f6revlileri Hakem Kurulu Karar\u0131yla belirlenmi\u015ftir. 03.09.2023 tarihli ve 32298 say\u0131l\u0131 Resmi Gazete\u2019de yay\u0131mlanan Kamu G\u00f6revlileri Hakem Kurulu Karar\u0131 01.01.2024-31.12.2025 tarihleri aras\u0131nda uygulanacak olup, y\u00fcr\u00fcrl\u00fc\u011fe girmi\u015ftir.<\/p>\n<p>Anayasa ve ilgili Kanunlardan kaynakl\u0131 olarak \u201c\u00f6zerk\u201d bir s\u00f6zle\u015fme niteli\u011finde olan Toplu S\u00f6zle\u015fme h\u00fck\u00fcmlerinin uygulanmas\u0131n\u0131n elzem oldu\u011fu tart\u0131\u015fmas\u0131z olmakla birlikte baz\u0131 kamu kurum ve kurulu\u015flar\u0131nda uygulanmad\u0131\u011f\u0131, uygulamaya d\u00f6n\u00fck teredd\u00fctlerin meydana geldi\u011fi, benzer kurumlarda farkl\u0131 uygulamalar\u0131n ger\u00e7ekle\u015ftirildi\u011fi yetkili Konfederasyon olarak taraf\u0131m\u0131za iletilmi\u015ftir.<\/p>\n<p>7. D\u00f6nem Kamu G\u00f6revlileri Hakem Kurulu Karar\u0131\u2019n\u0131n Teknik Personelin Ek \u00d6demesi ba\u015fl\u0131kl\u0131 52 nci maddesinin 1 inci f\u0131kras\u0131n\u0131n (b) bendinin, \u201c375 say\u0131l\u0131 Kanun H\u00fckm\u00fcnde Kararnamenin eki (I) say\u0131l\u0131 Cetvelin \u201c\u00c7- 399 say\u0131l\u0131 Kanun H\u00fckm\u00fcnde Kararname eki (II) say\u0131l\u0131 cetvele dahil pozisyonlarda istihdam edilen s\u00f6zle\u015fmeli personelden (527 say\u0131l\u0131 Kanun H\u00fckm\u00fcnde Kararnamenin 31 inci maddesine g\u00f6re \u00fccretleri belirlenen s\u00f6zle\u015fmeli personel dahil);\u201d k\u0131sm\u0131na g\u00f6re ek \u00f6deme yap\u0131lan ayn\u0131 veya benzer unvanl\u0131 s\u00f6zle\u015fmeli personel ile (a) bendine tabi emsali memur kadrolar\u0131 esas al\u0131nmak suretiyle ek \u00f6demeleri belirlenmi\u015f olan s\u00f6zle\u015fmeli personel pozisyonlar\u0131nda bulunanlar\u0131n 375 say\u0131l\u0131 Kanun H\u00fckm\u00fcnde Kararnameye g\u00f6re yararlanmakta olduklar\u0131 ek \u00f6deme oran\u0131na, ayn\u0131 veya benzer unvanl\u0131 emsal memur kadrosu i\u00e7in (a) bendinde \u00f6ng\u00f6r\u00fclen ile ayn\u0131 miktarda puan, ilave edilir.\u201d h\u00fckm\u00fcn\u00fcn Kamu \u0130ktisadi Te\u015febb\u00fcslerindeki baz\u0131 personele uygulanmad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.<\/p>\n<p>375 say\u0131l\u0131 Kanun H\u00fckm\u00fcnde Kararnamenin (I) say\u0131l\u0131 Cetvelin \u201c\u00c7- 399 say\u0131l\u0131 Kanun H\u00fckm\u00fcnde Kararname eki (II) say\u0131l\u0131 cetvele dahil pozisyonlarda istihdam edilen s\u00f6zle\u015fmeli personelden (527 say\u0131l\u0131 Kanun H\u00fckm\u00fcnde Kararnamenin 31 inci maddesine g\u00f6re \u00fccretleri belirlenen s\u00f6zle\u015fmeli personel dahil);\u201d k\u0131sm\u0131nda yer alan \u201cteknik \u015fef, teknik amir, teknik uzman, vb.\u201d personel ba\u015fta olmak \u00fczere ilgili k\u0131s\u0131mda belirtilen teknik personele ilave 20 puan ek \u00f6deme yap\u0131lmamaktad\u0131r. 375 say\u0131l\u0131 Kan\u0131n H\u00fckm\u00fcnde Kararnamenin (I) say\u0131l\u0131 Cetvelin (\u00c7) k\u0131sm\u0131nda ilgili personel birlikte say\u0131lmas\u0131na ve 7. D\u00f6nem Kamu G\u00f6revlileri Hakem Kurulu Karar\u0131n\u0131n 52 nci maddesinin 1 inci f\u0131kras\u0131n\u0131n (b) bendinden almas\u0131 gereken ilave 20 puanl\u0131k ek \u00f6demesi \u201cbenzer unvan\u201d tan\u0131m\u0131na uymad\u0131\u011f\u0131 d\u00fc\u015f\u00fcncesiyle \u00f6denmeyerek, \u00f6nemli bir ma\u011fduriyet olu\u015f(turul)makta, i\u015f bar\u0131\u015f\u0131n\u0131 ve hiyerar\u015fiyi olumsuz etkilemektedir.<\/p>\n<p>7. D\u00f6nem Kamu G\u00f6revlileri Hakem Kurulu Karar\u0131\u2019n\u0131n Teknik Personelin Ek \u00d6demesi ba\u015fl\u0131kl\u0131 52 nci maddesinin 1 inci f\u0131kras\u0131n\u0131n (b) bendinin \u201c\u2026k\u0131sm\u0131na g\u00f6re ek \u00f6deme yap\u0131lan ayn\u0131 veya benzer unvanl\u0131 s\u00f6zle\u015fmeli personel\u2026\u201d ibaresi h\u00fckm\u00fc a\u00e7\u0131k ve anla\u015f\u0131l\u0131r olmas\u0131na ra\u011fmen, Kamu \u0130ktisadi Te\u015febb\u00fcslerindeki ilgili teknik personelden grup ba\u015fm\u00fchendisi unvan\u0131 375 say\u0131l\u0131 KHK\u2019n\u0131n \u201c2- Kadrolar\u0131 Teknik Hizmetler S\u0131n\u0131f\u0131nda yer alan personel;\u201d k\u0131sm\u0131nda bulunmamas\u0131na ra\u011fmen benzer unvanl\u0131 kabul edilerek 20 puanl\u0131k ilave \u00f6deme yap\u0131lmakta, teknik \u015fef, teknik amir, teknik uzman, vb. teknik k\u00f6kenli personele 20 puanl\u0131k ilave \u00f6deme yap\u0131lmamaktad\u0131r.<\/p>\n<p>7. D\u00f6nem Kamu G\u00f6revlileri Hakem Kurulu Karar\u0131\u2019n\u0131n h\u00fck\u00fcmleri a\u00e7\u0131k ve net olmas\u0131na kar\u015f\u0131n teredd\u00fcd\u00fcn has\u0131l oldu\u011fu maddeye ili\u015fkin olarak; Toplu S\u00f6zle\u015fmenin 3\u2019\u00fcnc\u00fc maddesi; \u201cBu Karar\u0131n uygulamas\u0131na ili\u015fkin olarak ortaya \u00e7\u0131kabilecek teredd\u00fctleri gidermeye ve uygulamay\u0131 y\u00f6nlendirmeye, Cumhurba\u015fkanl\u0131\u011f\u0131 \u0130dari \u0130\u015fler Ba\u015fkanl\u0131\u011f\u0131, \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131, Hazine ve Maliye Bakanl\u0131\u011f\u0131 ile Strateji ve B\u00fct\u00e7e Ba\u015fkanl\u0131\u011f\u0131 g\u00f6revli ve yetkilidir.\u201d h\u00fckm\u00fcnde olup, Toplu S\u00f6zle\u015fme h\u00fckm\u00fcn\u00fcn uygulanmas\u0131nda kamu kurum ve kurulu\u015flar\u0131nca teredd\u00fct ya\u015fand\u0131\u011f\u0131 dikkate al\u0131narak, Konfederasyonumuzun da i\u00e7inde bulundu\u011fu Bakanl\u0131\u011f\u0131n\u0131z b\u00fcnyesinde bir komisyon olu\u015fturularak teredd\u00fcd\u00fcn giderilmesi gerekmektedir.
